Quabbin Reservoir Muslim Treaspassers - UPDATE

Muslims are overjoyed that a minor clerk magistrate has 'decided' not to issue criminal complaints against the Muslim students and professionals studying the Quabbin after midnight.



Nothing to see here, folks.





 According to the Republican ...
"They were summonsed to district court in Belchertown for a show-cause hearing for trespassing, where the clerk issued a continuance without a finding and declined to issue criminal complaints, according to David Procopio, Massachusetts State Police spokesman."

However, the Mass. State Police and other Islamaphobes have insisted on appealing the decision, since a local clerk-magistrate actually has no power to decide on public matters so important to our safety.

A Magistrate-Clerk is just an Administrative Clerk and can not make ANY judicial decisions or practice law.

The Clerk-Magistrate shall facilitate public access to court records.

     (6) A Clerk-Magistrate shall facilitate public access to court records that, by law or court rule, are available to the public and shall take appropriate steps to safeguard the security and confidentiality of court records that are not open to the public.


The names of the individuals are all a matter of public record, although neither the police or court clerks are required to offer the information over the telephone.

Who in the Mass. State Police Media Relations unit authorized blacking out the names of the individuals cited for trespassing at the Quabbin?

"The log from May 14 at the state police barracks at the Quabbin only shows a log entry of “trespass” at 00:30 hours with an area blacked out. State police attached to the barracks said the identifying information for the trespassers was removed from the public log by the state police media relations unit."

If anyone is interested in finding the names of these individuals, just ask one of the clerks at the Eastern Hampshire Court District Court for assistance in finding the name of the actual Magistrate that made the ruling and the Docket # of the case.

Mass. state police appeal Quabbin decision


BELCHERTOWN, Mass. (AP) — State police are appealing a decision by a clerk magistrate not to issue criminal complaints against seven people allegedly found trespassing at the Quabbin Reservoir last month.

The five men and two women weren't arrested, but went to district court in Belchertown for a show-cause hearing, where the clerk issued a continuance without a finding and declined to issue criminal complaints.

Spokesman David Procopio tells The Republican ( ) that because the trespassing happened at a "critical infrastructure" site, state police asked for judicial review of the decision.

Police say they are from Pakistan, Saudi Arabia and Singapore with addresses in Massachusetts and New York City.

It was determined they had no connection to any criminal activity.
They told police their curiosity was professional.
The 412-billion gallon Quabbin supplies the Boston area with drinking water.
